Is NRE Account Interest Tax-Free for OCI Cardholders in India?

I am a British citizen of Indian origin and have held an OCI card for several years. I currently live and work in the UK, and I am planning to transfer some of my savings to India for future family expenses and investments.

I recently spoke to a bank about opening an NRE savings account and possibly an NRE fixed deposit. The bank representative mentioned that NRE account interest is tax-free in India, but I want to understand whether this applies to OCI cardholders as well.

I am a little confused because I am not an Indian citizen anymore. I understand that OCI holders are foreign nationals, but I have also read that NRE accounts are available to eligible non-residents of Indian origin.

My questions are:

  1. Is NRE account interest tax-free for OCI cardholders living abroad?

  2. Does the exemption apply to both NRE savings account interest and NRE fixed deposit interest?

  3. Do I need to submit any special documents to the bank to claim the exemption?

  4. If I am a UK tax resident, do I need to declare the NRE interest in my UK tax return?

  5. What happens if I move back to India permanently in the future?

I already have an OCI card, foreign passport, and overseas residential address proof. I want to understand the tax treatment before opening the account.

Has anyone here opened an NRE account as an OCI cardholder? Did your bank explain the tax exemption and whether any TDS was deducted?

    One thing I would clarify is that an OCI cardholder is not automatically an Indian tax resident or non-resident just because they have an OCI card.

    The relevant rules need to be considered separately. For NRE interest exemption, the official Indian income-tax guidance refers to eligibility based on being a person resident outside India under FEMA or being permitted by the RBI to maintain the account.

    That means you should check your actual circumstances rather than relying only on citizenship or OCI status.

    I would also be careful about future relocation. If you return to India and your residential status changes, the bank may require you to review or redesignate your account. The tax treatment of interest can change depending on the applicable rules and your status.

    Keep copies of your account-opening documents, foreign passport, OCI card, and any bank correspondence. If your circumstances change, notify the bank promptly and ask for the correct account arrangement.

    I think the confusion often comes from mixing up NRE and NRO accounts.

    NRE accounts are generally used for overseas earnings remitted to India. Interest on an eligible NRE account is exempt from Indian income tax under the applicable provisions. NRO account interest, on the other hand, is generally taxable in India.

    I maintain both types of accounts because I have income from India as well as savings from abroad. The tax treatment is different, so I would not automatically assume that the exemption for NRE interest applies to every account held by an OCI cardholder.

    Also, check the difference between your bank's tax declaration and your actual tax residency. A bank may ask for documents to establish your non-resident status and regulatory eligibility.

    For the UK question, I would consult HMRC guidance or a tax professional familiar with overseas interest. Indian tax exemption and UK reporting obligations are separate issues.

    If you are planning an NRE FD, ask the bank whether the deposit qualifies under the same exemption conditions as your savings account.

    I am also an OCI cardholder living outside India, and I have an NRE savings account. My understanding is that NRE interest can be exempt from Indian income tax when the account holder meets the applicable eligibility conditions.

    The important point is that the exemption is not based on having an OCI card alone. You need to qualify under the relevant rules governing NRE accounts and non-resident status.

    I opened my account using my foreign passport, OCI card, overseas address proof, and other documents requested by the bank. The bank also checked my residential status and account eligibility.

    For your situation, I would ask the bank specifically whether your status qualifies under the applicable FEMA rules and whether the interest will be exempt under the current income-tax provisions.

    I would not assume that tax-free in India means tax-free in every country. Since you live in the UK, you should separately check the UK tax treatment of interest earned in India.

    Different banks may have different documentation and compliance procedures, so it is worth confirming the requirements before transferring a large amount.
