Can OCI Holders Have Both NRE and NRO Accounts in India?

I am a British citizen of Indian origin and have an OCI card. I have been living in the UK for almost six years and am planning to organize my banking arrangements in India.

Currently, I have an NRO savings account with an Indian bank, which I use for rental income from a property inherited from my parents. I also transfer some money from the UK to India for family expenses and future investments.

I am now considering opening an NRE savings account to keep my overseas savings separate. However, I am not sure whether an OCI holder can legally maintain both an NRE and NRO account at the same time.

I have read that NRE accounts are useful for foreign remittances and may offer tax-exempt interest in India, whereas NRO accounts are generally used for income earned in India. But I am confused about whether I need to close my existing NRO account before opening an NRE account.

My questions are:

  1. Can OCI cardholders maintain both NRE and NRO accounts with the same bank?

  2. Is it possible to have an NRE savings account and NRO fixed deposit simultaneously?

  3. Can I transfer money from my NRO account to my NRE account?

  4. Are there any restrictions on transferring rental income into an NRE account?

  5. What happens to both accounts if I return to India permanently?

I want to avoid any FEMA or tax compliance problems. Has anyone with an OCI card and foreign citizenship maintained both account types? How did your bank handle the account opening and documentation?

The RBI's guidance distinguishes between NRE and NRO accounts. NRE accounts are available to eligible NRIs and PIOs/OCIs, while NRO accounts can be opened by persons resident outside India for legitimate rupee transactions.

So, having both accounts is not inherently contradictory. The question is whether you qualify for each account and follow the applicable rules.

For the rental income question, I would keep the rent in the NRO account initially and ask the bank about permitted transfers or remittances. The fact that you hold an OCI card does not automatically change the source of that income.

If you plan to return to India, remember that your residential status may affect how your accounts are maintained. Ask the bank about redesignation when your circumstances change.

I would rely on the latest RBI guidance and your bank's compliance team rather than an old forum comment. Account rules and documentation requirements can be updated.

Yes, my understanding is that eligible OCI holders living outside India can maintain both NRE and NRO accounts. I have seen this arrangement among family members who receive income from India but also send savings from abroad.

The two accounts serve different purposes. NRE is generally used for eligible overseas funds, while NRO is commonly used for Indian income such as rent, dividends, or pension.

I would not close your NRO account just because you want to open an NRE account. Instead, ask your bank to confirm your eligibility and the permitted transactions for each account.

One thing to keep in mind is that not every type of money can be transferred freely between accounts. For example, Indian rental income and overseas remittances may have different documentation and tax considerations.

When I handled my own account updates, the bank asked for passport and residential-status documents. Your requirements may differ depending on the bank and your circumstances.

I maintain an NRO account for my Indian income and an NRE account for money transferred from abroad. My bank helped me set up both, but I had to complete separate account-opening formalities.

I think the main advantage of having both accounts is that you can separate the source of your money. NRO is useful when you have income or payments originating in India, while NRE can be useful for eligible foreign remittances.

However, I would be careful about assuming that all NRO funds can simply be moved into NRE without any conditions. The bank may ask for the source of funds, proof of income, and applicable tax documentation.

Also, don't confuse the account types with your OCI status. Being an OCI holder does not automatically mean every banking transaction is exempt from tax or permitted without restrictions.

Check your bank's latest NRE and NRO account rules before transferring your rental income or opening an FD.
