Can OCI Cardholders Repatriate Money From an NRE Account?

I’m a US citizen and OCI cardholder living in New Jersey. I have an NRE savings account in India, which I opened after becoming a US citizen. Most of the money in the account was transferred from my US bank account.

I may need to move some of the money back to the US later this year, so I’m trying to understand the repatriation rules for an NRE account.

Can an OCI cardholder freely repatriate money from an NRE account to their overseas bank account? Does this apply to both the original amount I transferred to India and the interest earned on the NRE account?

I’ve read that NRE accounts are fully repatriable, but I’m not sure whether OCI holders have the same facility as NRIs. I also have an NRO account because I receive some rental income in India, so I’m trying to keep the two accounts separate.

Has anyone with an OCI card recently transferred money from an NRE account back to the US? Did your bank ask for any documents or a reason for the transfer?

I’m looking for recent experiences because I don't want to assume the rules based on something I read several years ago.

    One thing I'd clarify is that having an OCI card doesn't mean you're an Indian citizen. You're a foreign citizen with OCI status.

    For banking purposes, however, RBI's framework allows eligible OCI/PIO persons resident outside India to maintain relevant non-resident accounts. The NRE account itself is a repatriable account.

    So if the funds are legitimately held in an NRE account, the account's repatriable nature is the important point.

    The situation is different if you're talking about transferring money from an NRO account. NRO balances aren't simply treated the same way as NRE balances; different limits and conditions apply.

    I'd ask your bank's NRI/forex department about the exact outward-remittance procedure before initiating a large transfer.

    Yes, my experience has been similar. I'm an OCI holder living in Australia and maintain both NRE and NRO accounts.

    The important distinction is that NRE balances are repatriable, while NRO balances have different repatriation restrictions. RBI's FAQ states that NRE account balances are repatriable, whereas NRO balances are generally subject to the applicable USD 1 million facility and conditions.

    I moved money from my NRE account to my Australian bank account last year. The bank processed it as an outward remittance.

    I wouldn't mix rental income into the NRE account. I keep Indian-sourced income in the NRO account and overseas funds in the NRE account. That makes the source of funds much easier to explain if the bank asks questions.

    I’m a British citizen with OCI and have an NRE account in India. I’ve repatriated money from it to my UK bank account without any issue.

    The NRE account is specifically designed to hold funds that remain repatriable. RBI's current guidance describes NRE accounts as repatriable, and permitted debits include remittances outside India.

    In my case, the money had originally come from my UK account, so I just instructed my Indian bank to remit the funds back to my overseas account.

    The bank did its normal verification and asked me to confirm my overseas bank details. I didn't have to use the USD 1 million facility that applies to certain NRO repatriations.

    I would still check with your bank before making the transfer because the bank may have its own documentation and transaction procedures.
