Hi everyone,
I am an OCI cardholder living in Australia. I previously worked in India and am now receiving a pension from my former employer. I have been living outside India for several years and want to make sure the pension is credited to the correct type of Indian bank account.
At the moment, my pension is being credited to my old resident savings account. Since I am now an OCI holder and live permanently in Australia, I am wondering whether I should convert the account to an NRO account.
I have a foreign passport, OCI card and PAN. My pension is from India and is paid in Indian rupees.
I went through something similar after becoming a foreign citizen.
My bank asked me to update my KYC and change my resident account status after I became a non-resident. They wanted my foreign passport, OCI card, overseas address, and PAN details.
My pension itself continued to be payable in India. The important thing was making sure the bank had the correct residential status.
I would not close your existing account before speaking to the pension-paying authority and your bank. Ask whether the pension can continue to be credited after the account is redesignated as NRO.
Also, don't assume that transferring the pension to Australia is automatic. RBI permits certain current-income remittances from NRO accounts, but the bank may ask for supporting documents and confirmation that applicable taxes have been dealt with.
Yes, pension is specifically included among the types of current income that can be credited to an NRO account. RBI guidance lists pension, rent, dividend, and interest among legitimate dues/current income of a person resident outside India.
So, if you are an OCI holder living outside India and are otherwise eligible for an NRO account, receiving an Indian pension through the NRO account is generally possible.
The bigger issue in your case is probably the old resident savings account. Once your residential status changes to non-resident, you should speak with your bank about redesignating the account appropriately rather than continuing to operate a resident account as before.
For the tax side, I would check with a CA because pension taxation depends on the nature of the pension and your circumstances.
Also ask the bank whether it needs your pension payment order, employer/department letter, PAN, or other documentation before changing the account.

One useful distinction is between receiving a pension in India and repatriating the pension overseas.
RBI's NRO framework specifically permits credits for legitimate dues in India, including pension. It also permits remittance of current income such as pension from an NRO account, subject to the applicable rules and bank requirements.
Therefore, having an NRO account does not necessarily mean your pension has to remain permanently in India.
The bank may require documentation before making an overseas transfer. Tax compliance can also matter, so I would keep your pension statements and tax records.
If the pension is from a government department, I would also confirm with the pension-paying authority whether they have any separate procedure for an OCI holder who has become non-resident.
