Can OCI Cardholders Receive Rental Income in an NRO Account in India?

Hi everyone,

I am an OCI cardholder living in the UK, and I own a residential property in India that I have rented out. My tenant currently transfers the monthly rent to my Indian savings account, but I am planning to convert my banking arrangements to an NRO account.

I want to understand whether OCI cardholders can legally receive rental income in an NRO account and whether there are any tax or repatriation requirements.

I have a foreign passport, OCI card, PAN card, and property documents. I am not currently living in India and visit only occasionally.

My main questions are:

  1. Can OCI cardholders receive rental income directly into an NRO account?

  2. Is rental income taxable in India for OCI holders living abroad?

  3. Does the tenant need to deduct TDS before transferring the rent?

  4. Can I transfer rental income from my NRO account to my UK bank account?

  5. Do I need a separate NRE account for transferring rental income abroad?

I have read that NRO accounts are commonly used for income earned in India, but I am not sure how the rules apply specifically to OCI holders.

Has anyone with an Indian rental property and an NRO account dealt with this? What documents did your bank request, and how did you manage the tax and repatriation process?

    An NRO account is generally used for receiving legitimate income earned in India, including rental income.

     

    The RBI permits repatriation of eligible NRO balances by NRIs and PIOs within the applicable limits and conditions. The RBI's guidance refers to a general limit of USD 1 million per financial year, subject to applicable requirements.

     

    However, there is a distinction between the repatriation of current income and the transfer of other NRO balances. The documentation and tax compliance can vary.

     

    I would ask your bank whether the transfer can be processed as current income or whether additional documentation is needed. You should also check the applicable tax requirements before initiating a remittance.

     

    The fact that you hold an OCI card does not remove your responsibility to follow Indian tax and banking rules.

    I am an OCI holder living in the UK, and I also receive rental income from property in India.

    In my case, I found it important to understand the tax side before transferring any money overseas. The rent is Indian-source income, so I did not treat it the same way as money I earn in the UK.

    I would suggest checking the following:

    • Whether the tenant has TDS obligations.
    • How rental income should be reported in your Indian income tax return.
    • Whether deductions are available under the applicable tax rules.
    • What documents the bank requires for outward remittance.

    The bank may also ask for information about the source of funds and the purpose of the transfer.

    I would not assume that all rental income can automatically be transferred abroad without documentation. Ask the bank for its current repatriation procedure.

    Yes, OCI holders who are resident outside India can generally receive rental income from Indian property into an NRO account.

    I use an NRO account for managing income earned in India, and the bank explained that rental income is treated differently from overseas earnings. An NRO account is commonly used for Indian-source income, including rent.

     

    ICICI Bank's NRI rental property guidance recommends using an NRO account to receive rental income. It also explains that rental income is subject to applicable Indian tax requirements.

     

    One important point is that receiving rent and transferring it abroad are separate matters. You should ask your bank about the documentation required for repatriation and consult a tax professional regarding applicable tax compliance.

     

    I would also recommend keeping your rental agreement, property ownership documents, PAN details, and bank records organized. Your bank may request supporting documents depending on the transaction.

     

    Rules and procedures can change, so confirm the current requirements with your bank.
