How to Open Business in USA on H4 Visa?

You can open a business in the USA with an H4 visa but for that, you must obtain an Employment Authorization Document (EAD). Your involvement in the business must be limited to certain activities like strategic planning, decision-making, and financial investments. Your involvement must not break the terms of your H4 visa status

    I would separate the process into three buckets because I initially mixed everything together:

    Immigration: Are you authorized to perform the work?

    Business registration: Can you form the LLC or other business entity under your state's rules?

    Tax: How will the business income be reported?

    For example, the IRS says a single-member domestic LLC is generally treated as a disregarded entity for federal income-tax purposes unless the owner elects corporate treatment.

    That tax classification doesn't determine whether an H-4 spouse is authorized to work.

    If you want to actively operate the business yourself, I'd verify your H-4 EAD eligibility and make sure your employment authorization is actually valid before doing the work.

    I also wouldn't assume that simply receiving business income makes something okay because the money goes into an LLC bank account. The underlying activity and your role in the business matter.

    For the business-registration side, check the Secretary of State or other relevant agency in the state where you're forming the company. State requirements can differ.

    For the immigration part, USCIS is the source I'd rely on rather than random LLC websites or social-media posts.

    I haven't personally operated a business on H-4, but I went through the same research when my spouse was on H-1B.

    One thing that helped was not treating an LLC as an immigration authorization document. An LLC is basically a state-law business structure. The IRS explains that an LLC can be classified differently for federal tax purposes depending on the number of members and elections made.

    So forming an LLC doesn't automatically answer whether you can work for it.

    If you're going to personally provide consulting services, handle customers, develop products, sell services or perform day-to-day business work, I would specifically look at your employment authorization.

    USCIS's Form I-765 instructions list H-4 spouse (C26) as an employment authorization category.

    Another thing to consider is taxes. Once you actually operate the business, you'll have federal and possibly state tax obligations. The IRS says new business owners should choose a business structure, determine applicable tax requirements and check state-specific requirements.

    I wouldn't base the immigration decision on what type of company you create. The key question is what activities you personally perform.

    The distinction between owning a company and working for that company is the part I would focus on.

    I’m also an H-4 spouse and eventually obtained an H-4 EAD before actively working on my business. I didn't want to rely on statements from online forums that simply said “H-4 holders can start businesses.”

    USCIS has a specific employment authorization category for certain H-4 spouses of H-1B nonimmigrants. The Form I-765 instructions identify H-4 spouses as category (c)(26).

    Once I had employment authorization, I felt much more comfortable actually performing services for my business.

    I would be careful about assuming that creating an LLC itself gives you permission to work in the United States. The LLC is a business entity created under state law, while your ability to personally perform work is an immigration-status question.

    The IRS recognizes several business structures, including sole proprietorships, partnerships, corporations and LLCs.

    So there are really two separate questions:

    1. Can the business entity be formed?
    2. Can you personally perform services/work for that business while in H-4 status?

    I would get those questions answered separately before starting operations.
