Is a Refugee/stateless Person Allowed to Be Registered as OCI Cardholder?

No, a stateless/refugee person of any country cannot apply for an OCI card or register for an OCI card on the spouse's basis. If a person has an OCI card and they get refugee status in another country, then under those conditions his/her OCI card will be ceased and they need to apply for a valid visa to travel to India.

    One thing to remember is that proving Indian ancestry and qualifying for OCI are not always the same thing.

    A friend of mine had extensive documentation proving family connections to India, but the authorities still focused heavily on current citizenship documents, passport validity, and legal status in the country of residence.

    In unusual situations involving refugees, asylum holders, or stateless persons, additional scrutiny is common because standard OCI applications are built around foreign nationality documentation.

    If your relative eventually acquires citizenship in another country, the OCI pathway may become much clearer, assuming all other eligibility requirements are met.

    I asked a similar question at an Indian Consulate information session in Europe because someone in our community had refugee status.

    The explanation given at the time was that OCI eligibility is tied not only to Indian origin but also to the applicant's present citizenship status. The person conducting the session mentioned that refugee travel documents and stateless status could create eligibility issues because OCI registration is generally designed for foreign citizens.

    I never saw the final outcome of that individual's case, but they were advised to obtain clarification from the consulate before preparing an application.

    Requirements and interpretations can change, so I would definitely check the latest official guidance.

    I haven't personally applied as a refugee or stateless person, but I did help a family member gather OCI documents a few years ago.

    During our research, one of the key requirements seemed to be holding citizenship of a foreign country and possessing a valid foreign passport. The OCI application asked for details of current nationality and passport information.

    From what I remember, OCI is generally issued to eligible foreign nationals of Indian origin rather than individuals who do not hold any nationality. Because of that, refugee travel documents alone may not satisfy the passport and citizenship requirements.

    That said, special situations can be complex, and consulates sometimes request additional documentation. You may want to verify the latest position directly with the relevant Indian mission.

    Stateless/ refugee people don't have a valid citizenship of any country, and because they don't have any historical connection to India or any descendants, they are not qualified for the OCI registration. According to the government of India, only these are eligible to apply for an OCI. 

     

    • Who is a citizen of India at the time of the formation of the Constitution, which is 26 January 1950.  
    • Who is eligible to get indian citizenship or become an Indian citizen on January, 26,1950.
    • Child of Indian origin parents, grandparents, and great-grandparents. 
    • Minor who is a child of parents, grandparents, or great-grandparents. 
    • Who belonged to the Indian territory on and after 15 August 1947.
