Can OCI Holders Repatriate Money From an NRO Account?

I’m a Canadian citizen and OCI cardholder living in Toronto. I have an NRO savings account in India, which I use for Indian income, including rent from a property I own in Maharashtra.

I’m now planning to move some of the money from my NRO account to my Canadian bank account. I understand that NRO accounts have different rules from NRE accounts, so I’m not sure how much I can repatriate.

Can OCI holders repatriate money from an NRO account to an overseas bank account? I’ve seen references to a USD 1 million per financial year limit, but I’m not sure whether this applies to OCI cardholders as well.

Also, does the USD 1 million limit apply only to the balance in the NRO account, or can it include proceeds from other assets in India? What happens with rental income and taxes paid in India?

Has anyone recently made an NRO repatriation as an OCI holder? I’d particularly like to know what documents the bank requested and whether Form 15CA/15CB or tax-related paperwork was involved.

I’m not trying to transfer a huge amount immediately, but I want to understand the process before asking my bank to initiate the transfer.

    The main distinction is NRO versus NRE.

    NRE balances are generally repatriable, while NRO balances are subject to specific restrictions. RBI currently states that NRO balances of eligible NRIs/PIOs can be remitted abroad up to USD 1 million per financial year, along with other eligible assets, subject to the applicable conditions.

    So an OCI holder shouldn't assume that having an NRO account means they can transfer the entire balance overseas whenever they want.

    If your money is mainly rental income, keep records of the rental receipts and Indian tax payments. The bank may ask for supporting documents before approving the remittance.

    I'd also check the current tax documentation requirements with your bank or a qualified tax professional because those requirements can depend on the nature and source of the funds.

    I did this after becoming a British citizen and getting OCI.

    I had accumulated money in my NRO account from rent and some other Indian income. My bank explained that NRO balances aren't simply "fully repatriable" like NRE balances.

    The USD 1 million per financial year facility was relevant in my case. RBI's guidance says this facility covers eligible NRI/PIO remittances from NRO balances, subject to the prescribed conditions.

    The bank checked the source of the funds and tax position before processing the outward remittance.

    One thing I'd recommend is not assuming that every amount sitting in an NRO account automatically qualifies without documentation. If the balance includes property-sale proceeds, inheritance or other assets, additional rules can apply.

    Yes, OCI holders can repatriate funds from an NRO account, but it isn't the same as the unrestricted repatriation available with an NRE account.

    RBI's current FAQ states that NRIs/PIOs can remit balances from an NRO account of up to USD 1 million per financial year, subject to the applicable conditions under the Foreign Exchange Management (Remittance of Assets) Regulations. The limit is from April to March.

    Since you're an OCI holder, the bank will need to establish your eligibility and status under the applicable PIO framework.

    I haven't personally transferred a large amount, but my bank asked for documentation showing the source of funds and confirmation that applicable Indian taxes had been dealt with.

    For rental income, I'd definitely speak with the bank's NRI/forex department before initiating the transfer. They can tell you exactly what tax and remittance forms they currently require.
