Can a Foreigner on a Tourist Visa Marry an Indian?

My experience was slightly different because we initially planned to marry during a short visit.

The challenge wasn't whether I could marry while on a tourist visa. The challenge was meeting the procedural requirements and timelines. Some registrations required advance notice, document verification, and in certain cases additional paperwork from my home country.

We postponed the registration because my travel schedule wasn't long enough to complete all the required steps.

I'm a Canadian citizen and married my Indian spouse in Delhi in 2025.

The registrar requested:

• Passport
• Valid visa
• Address proof
• Passport photographs
• Birth-related documents
• Affidavits regarding marital status

I entered India on a tourist visa and did not face any questions about the visa category. Most of the discussion focused on whether our documents met the registration requirements.

When the foreign traveler on a tourist visa marries an Indian citizen, then they need to apply for the conversion of their tourist visa to an Indian X2 visa through the Foreign Regional Registration Office (FRRO) more from the Foreign Registration Office (FRO). Then they need to get their marriage certificates, which should be registered with the government and in accordance with all the Indian laws and regulations.

Here are some of the documents that need to be collected by the foreign national before marrying an Indian citizen on a tourist visa: 

• The application form. 
• Birth certificate.
• Proof of the address for both couples. 
• Affidavits of both couples marrying together. 
• A copy of a valid passport of the foreigner. 
• A valid tourist visa for a foreigner. 
• Minimum three witnesses with their government-approved ID and 2 passport-size photos
• No objection certificate.
