Yes, a foreigner can marry an Indian citizen even if they had a tourist visa. There are some conditions that lead to being followed by the foreign visitor, which are that the marriage can be registered only when the visa is still valid, and then the foreigner's visa should be converted to an X2 visa. Additionally, the couple should meet all the Special Marriage Act, and submit all the essential documents for the marriage registration.

    When the foreign traveler on a tourist visa marries an Indian citizen, then they need to apply for the conversion of their tourist visa to an Indian X2 visa through the Foreign Regional Registration Office (FRRO) more from the Foreign Registration Office (FRO). Then they need to get their marriage certificates, which should be registered with the government and in accordance with all the Indian laws and regulations.

      The foreigner on a tourist visa can marry an Indian citizen, which is a two-step process, and it is possible under the Indian Special Marriage Act, which requires a minimum 30-day residency rule. If a foreign individual stays in India for a minimum of 30 days, then he or she can marry an Indian citizen.

    Here are some of the documents that need to be collected by the foreign national before marrying an Indian citizen on a tourist visa: 

    • The application form. 
    • Birth certificate.
    • Proof of the address for both couples. 
    • Affidavits of both couples marrying together. 
    • A copy of a valid passport of the foreigner. 
    • A valid tourist visa for a foreigner. 
    • Minimum three witnesses with their government-approved ID and 2 passport-size photos
    • No objection certificate.
