Can an OCI Cardholder Open an NRE Account in India?

I’m a US citizen and OCI cardholder, and I’m currently living in the US. I became a US citizen a few years ago and recently started looking into opening a bank account in India for managing my Indian funds.

I keep seeing information about NRE and NRO accounts, but I’m confused about whether an OCI cardholder can actually open an NRE account. Most of the information I find talks about NRIs, while I’m no longer an Indian citizen.

I still have an old savings account in India from before I became a US citizen. I haven't made any changes to it yet because I wasn't sure what I was supposed to do after becoming a foreign citizen with OCI status.

I’m mainly looking for an account that I can use for money transferred from my US account. I also have some financial interests in India, so I’m trying to understand whether an NRE account would be suitable or whether I would need an NRO account as well.

Has anyone here gone through this after becoming a foreign citizen and getting an OCI card? I’d especially like to know how the bank handled the existing savings account and whether there were any issues when applying for an NRE account.

I’m planning to contact my bank directly, but I wanted to hear from people who have actually gone through the process recently.

    The important thing here is not simply “OCI = NRE.”

    Your residential status and the FEMA classification applicable to you matter. RBI's current FAQ defines an NRI as a person resident outside India who is an Indian citizen, while it separately describes a PIO and expressly includes an OCI cardholder who is resident outside India within that category.

    So someone who became a US citizen and subsequently obtained an OCI card should not assume that they are an NRI in the citizenship sense. However, they may still qualify under the PIO category for the relevant banking rules.

    If you already have an Indian resident savings account, I'd speak to the bank's NRI/foreign-customer desk rather than just the regular branch counter. Ask specifically:

    “I am a US citizen, OCI cardholder, and resident in the US. What is the correct status of my existing Indian savings account, and am I eligible for an NRE account under the applicable FEMA/RBI rules?”

    That usually gets you to the right department faster.

    Yes, an OCI cardholder can generally be eligible for an NRE account if they meet the applicable non-resident/PIO conditions.

    I had a slightly different experience because my bank initially told me that “NRE is only for NRIs.” I went back to the RBI FAQ because it specifically says that the PIO category includes an OCI cardholder who is resident outside India. It also lists NRIs and PIOs as eligible to open NRE accounts.

    After the bank reviewed the case, they gave me the documentation requirements.

    I would not rely only on what a branch employee says verbally, though. Different banks have different onboarding procedures, particularly for customers who are foreign citizens and OCI holders.

    Also, don't confuse NRE and NRO accounts. They serve different purposes. If you have income arising in India, such as rent or certain investment income, you should separately check how that income is supposed to be credited and taxed.

    In my case, having an NRE account did not mean I stopped needing an NRO account for everything.

    I went through something similar after becoming a US citizen. I had an OCI card and was living in the US when I approached my bank in India.

    The bank told me that OCI status by itself doesn't make someone an Indian citizen, but an OCI cardholder who is resident outside India can fall under the PIO category for FEMA banking purposes. RBI's FAQ specifically includes an OCI cardholder within the PIO definition for these account rules.

    I was therefore able to ask the bank about an NRE account for OCI holders rather than assuming that NRO was the only option.

    The documents requested in my case included my foreign passport, OCI card, overseas address proof, and the bank's KYC forms. The exact list can depend on the bank and how the account is opened.

    One thing I would definitely check is your existing resident savings account. If you've become non-resident, don't simply continue treating the old resident account as a normal resident account. Ask the bank what conversion is required.

    My experience was that the account-opening process and KYC requirements were more important than the fact that I had previously been an Indian citizen.
