How Can I Appeal an Immigration Denial Decision?

You can appeal an immigration denial decision by filing an appeal case with the Administrative Appeals Office (AAO) of the U.S. Citizenship, you can appeal the USCIS decision to AAO, you can use form 1290B to file an appeal, and Immigration Service (USCIS) or the Board of Immigration Appeals (BIA), you can use form E026 to file an appeal.

    My student visa for the UK got rejected due to insufficient funds. I appealed for it within the given time frame with updated bank statements, and it was later approved. As per my experience, when appealing, provide solid and clear evidence to deny the visa rejection and strengthen your case.

    My wife's visa was denied, and to obtain an accurate result, I appealed through a legal representative. Although the immigration appeal process is stressful, having a legal representative by your side eases the process, as they know how to better handle the situation. Also, ensure that you respond to queries promptly and provide strong supporting documentation.

    Appealing for an immigration denial decision depends on the visa type and the country where you applied. I applied for a US visa, and when my application was rejected, I had to fill out the Form I-290B, which took months to process.  Additionally, I recommend consulting a visa consultant if you are unsure about the application process.
