I am an Indian-origin applicant living in the United States and planning to apply for an OCI card. I recently noticed that my name is not exactly the same on my US passport and my old Indian passport and other Indian documents.
For example, my Indian passport has my full name, including my middle name, while my US passport has only my first and last name. In some documents, my surname is different because I changed it after marriage.
I am worried that this mismatch could cause my OCI application to be rejected or delayed. I am not sure whether I should enter the name exactly as it appears on my US passport or use the name from my old Indian passport.
Do I need to submit a name-change affidavit, marriage certificate, court order or any other supporting document? What if the difference is only a spelling mistake or an abbreviated middle name?
I would appreciate advice from anyone who has applied for OCI in the USA with different names on their Indian and US documents. I want to make sure I fill out the application correctly and avoid unnecessary delays.
If you have already submitted your OCI application and the name difference was not explained, contact the application centre or Indian Mission handling your application before submitting another form.
If your OCI has already been issued and you need to correct personal particulars, the OCI Miscellaneous Services process may be relevant. The official OCI portal includes correction of wrong personal particulars, including name, among the available services for existing OCI cardholders.
Keep copies of the old and current passports, citizenship or naturalisation certificate, marriage certificate or legal name-change document, and any previous OCI or surrender documentation.
I would avoid changing your name on another document just to make everything match without first confirming which name is legally correct. A clear document trail is usually more helpful than making an unnecessary change.
For the OCI application, the name entered in the current foreign passport details should generally match your valid US passport. However, if your current name differs from the name recorded in your last Indian passport, you should disclose the previous name in the appropriate part of the application.
The US OCI checklist specifically gives examples of differences such as a surname change after marriage, an abbreviated middle name, a spelling variation and a change in the order of names. It instructs applicants to mention the name from the last-held Indian passport as the previous name.
The important thing is to explain the difference rather than leaving it unexplained. Keep your Indian passport, US passport and supporting documents ready.
If the difference is due to marriage, a marriage certificate may help establish the connection between the names. If it is a legal name change, check whether a court order or other name-change evidence is required under the current checklist.

I would not assume that every name mismatch needs the same affidavit. The supporting document depends on why the names differ.
For example:
The Indian Consulate or VFS checklist for your jurisdiction is the best place to confirm what is required. I would also make sure your date of birth matches between your current foreign passport and last-held Indian passport, because the US OCI checklist flags date-of-birth mismatches as a serious issue.
